You are NOT going to get "full value". They go by KBB and adjust it for how much that year/model is worth. You can try to sue the other driver. If you have the money. They have figured this scheme out way before your accident.
I know my insurance requires a Drunk Driver and Uninssured Added on, like $15 a month, but there are a plethora of lawyers going after insurrance companies cheating customers out of their full settlement or wirth...
I can’t give you advice on how to sue a car insurance company, but I can tell you what it’s like BEING sued by a personal injury attorney and my auto insurance company’s lawyer representing me (in the state of TX):
Last year I lightly tapped this lady’s rear bumper. The damage was absolutely minimal and I politely gave her my insurance info and even a picture of my drivers license.
A month later I was served papers, informing me that the lady intends to sue me for bodily injury.
My auto insurance company arranged an attorney for me (all-state), who ensured me that this wasn’t even going to get to trial. The lady claimed that the collision caused her some back injury called spendilosis (or something like that. It’s basically a back injury that’s hard to prove, and doctors will sign notes for kick-backs).
Anyway, long story short, she claimed that she wanted compensation for all sorts of medical bills she had. My lawyer ended up settling out of court with her for $3k (she wanted a ridiculous amount like $30k or something). Her lawyer took like over half of the money LOL. Also, the settlement money was covered by my insurance too. Unfortunately, this incident did raise my rates.
So yeah, a bodily injury lawyer would probably gladly help you get some money. Before you do so, make sure you don’t talk to the dude that drove into you. Don’t even exchange text messages or anything. Let the lawyer handle it for you. I imagine ideally you’d find a personal injury attorney that knows all the dirty tricks and who will work for a commission of the eventual court settlement.
This was quite the experience to go through. The whole legal process took over a year (and that was with an out-of-court settlement. Had the lady decided to take me to court who knows how many years this would have dragged on).
