My issue is that the Toronto Police is threatening to arrest me for criminal harassment because I have exercised my rights to complain against a former health professional, with whom intimate acts were involved. The police warned me that if I make further complaints to her regulatory body, I will get charged for criminal harassment. The police officer told me that if I withdraw my complaint against the health professional, it would be okay. However, my lawyer told me that under the Registered Health Professionals Act, I have a legal right to lodge a complaint at the regulator. The lawyer believes that the health professional perceives correspondence from her Regulatory College as indirect contact, or criminal harassment, per se. My question: Is Section 264 of the Criminal Code being used to oppress men rather than to keep the peace?" Well Mr. Anonymous thanks for the donation and topic. I'll get to it in just a moment. So Mr. Anonymous the first thing I want to do is reas section 264 from the Canadian Criminal Justice code and then I'll share my feelings about it. But remember that I'm not a lawyer so my interpretation isn't legal advice. It's just my opinion. So section 264 is the law for criminal harassment and it reads as follows and I quote: "No person shall, without lawful authority and knowing that another person is harassed or or recklessly as to whether the other person is harassed, engage in conduct referred to in subsection (2) that causes that other person reasonably, in all the circumstances, to fear for their safety or the safety of anyone known to them." unquote. Mr. Anonymous I don't understand how what you're doing is criminal harassment if you're not in direct contact with that person so how is it that they would argue on reasonable grounds that they are afraid for their safety? Your lawyer is right about this situation but my thinking is that maybe the college of physicians or regulatory medical body that you filed the complaint with have buddy buddy arrangement with the police. Maybe they pay them for the protection of their members. This sort of thing happens all the time and they probably made a call and you were on the receiving end of a phone call where the cops threatened to break your metaphorical knee caps. The idea of course is to make you scared of being arrested and detained to the point where you lose your job and ruin your life so you won't do it. What you have to do is ask yourself what are you willing to lose to punish this woman? Is it really worth it? The police are telling you that they will make sure it's not worth your while to persue this matter. Your lawyer probably wants you to persue it because there's a paycheck on the other end for them regardless of what happens. There is another possibility. Maybe the former female doctor or medical professional you were involved with told the police that you were abusive to her and that you were just filing a complaint to get back at her for dumping you. Who's word do you think some Toronto Wap cop is going to take? A female that claims a man did her wrong or a man? Remember that in our society women come first, then children, then pets and then finally men.
